Please read these Terms of Use before using the Service.
These Terms of Use (the "Terms") set forth the conditions for use of the app "nomow" (the "Service") provided by rarzyu (the "Operator").
Article 1 (Application)
These Terms apply to all aspects of the relationship between the User and the Operator regarding use of the Service.
Article 2 (In-App Purchases)
- Products and Pricing: The Service offers some features as paid in-app purchases (one-time purchase, "Premium"). Prices are shown on the purchase screen.
- Purchase Confirmation: A purchase is confirmed when the User completes the purchase process in the App Store or Google Play.
- Refunds: Payments already made are generally non-refundable regardless of reason, except where required by law.
- Store Policies: Premium purchases and refunds are subject to the terms and policies of the app store (App Store or Google Play) used by the User.
Article 3 (Prohibited Activities)
Users must not engage in the following activities:
- Acts that violate laws or public order and morals
- Acts that destroy or interfere with the functions of servers or networks of the Service
- Acts that intentionally exploit defects in the Service
- Reverse engineering, decompilation, or disassembly of the Service
- Other acts that the Operator deems inappropriate
Article 4 (Privacy)
The Operator's Privacy Policy applies to the use of the Service. Please refer to that policy for information on how personal information is collected, used, and protected.
Article 5 (Changes to Service)
The Operator may change or discontinue the Service without prior notice to Users. The Operator is not liable for any damages caused to Users thereby, except in cases of the Operator's willful misconduct or gross negligence.
Article 6 (Disclaimer)
- The Operator does not warrant, either expressly or implied, that the Service is free from defects (including defects in safety, reliability, accuracy, completeness, validity, fitness for a particular purpose, security, errors, bugs, or infringement of rights).
- The Operator is not liable for any damages (including data loss) arising from the Service. However, this does not apply in cases of the Operator's willful misconduct or gross negligence under a consumer contract.
- The Service does not provide medical advice. Always follow the guidance of a healthcare professional for medication management.
Article 7 (User Responsibility)
Users are responsible for all acts and their results performed using the Service. If a User causes damage to the Operator or a third party through use of the Service, the User shall compensate for such damage at their own expense.
Article 8 (Usage Environment)
- Users shall prepare and maintain at their own expense and responsibility the smartphone devices, communication equipment, communication lines, OS, and applications necessary to use the Service.
- The Operator does not guarantee that the Service will function properly in all devices, OS versions, or network environments.
Article 9 (Use by Minors)
- If a User is a minor, they must obtain the consent of a parent or legal guardian before using the Service or purchasing paid features.
- If a minor has used the Service without the consent of a legal guardian, the use cannot be rescinded on grounds of legal capacity.
Article 10 (Exclusion of Anti-Social Forces)
- Users warrant that they do not now and will not in the future belong to organized crime groups or other anti-social forces, nor have relationships with such forces that are socially criticized.
- If the Operator determines that a User has violated the preceding clause, it may take necessary measures without prior notice.
Article 11 (Prohibition of Assignment)
- Users may not assign, share, sell, transfer, or use as collateral any rights or obligations under these Terms to third parties.
- If the Operator transfers its business related to the Service, it may transfer rights and obligations under these Terms to the transferee, and Users consent to such transfer in advance.
Article 12 (Intellectual Property)
- All copyrights, trademarks, and other intellectual property rights related to the Service and its associated software, design, logos, text, images, and other content belong to the Operator or third parties with legitimate rights.
- Users may not use content obtained through the Service beyond the scope of personal use without explicit permission from the Operator.
Article 13 (Amendments)
- The Operator may amend these Terms as necessary.
- Amended Terms take effect when posted within the Service or on the Operator's website.
- If a User continues to use the Service after an amendment, they are deemed to have agreed to the amended Terms.
Article 14 (Governing Law and Jurisdiction)
These Terms are governed by Japanese law. Any disputes relating to the Service shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.
